Our team of specialist business immigration lawyers is very experienced and is highly recommended.

Sydney Mitchell is an award winning law firm specialising in assisting individuals and businesses with immigration advice and representation.

Our Business Immigration Team can assist individuals and businesses with a number of corporate and commercial business immigration matters. We also understand that it is necessary for many businesses to bring in talent by employing foreign nationals from abroad and may be even more so after Brexit.

Andre Minnaar and Melissa Southall have extensive experience dealing with the UKVI (UK Visas and Immigration) and making applications.  We can save you time, money and the stress whilst guiding you through the process, applications and any future compliance issues.

Examples of the types of visas we can assist with are:

Tier 1 Visas

Tier 1 Innovator

This category of visa is for individuals looking to set up or run a business in the UK. It replaces the old Tier 1 Entrepreneur visa.

The business you are setting up must be endorsed by an approved body. A list of these can be found on the Home Office website: https://www.gov.uk/government/publications/endorsing-bodies-innovator

In order to obtain endorsement you will need to have a business idea which is

  • New
  • Viable, it must have potential for growth.

If you are setting up a new business and applying under this visa route then you must have at least £50,000 in funds available to invest.

If granted, a period of 3 years leave to remain is given, which can be extended or if eligible you may be able to apply for Indefinite Leave to Remain.

Tier 1 Start up

This category is for individuals wishing to set up a business in the UK.

However, to apply you will require endorsement from an authorised body; namely, a higher education institution in the UK or a business which has a history of supporting UK entrepreneurs.

The Home Office specify that you must also show:

  • Your idea is new;
  • Innovative; and
  • Viable

Endorsement of your idea is required from one of the Home Office approved endorsing bodies. A list of these can be found on the Home Office website: https://www.gov.uk/government/publications/endorsing-bodies-start-up/start-up

If successful you will be granted a period of 2 years Leave to Remain in the UK. There is no option to extend this but there may be other options available which you can switch to.

Visas can be withdrawn if endorsement from the authorised body is withdrawn.

Global Talent

The Tier 1 ( Exceptional Talent) route has now closed and has been replaced by the Global Talent visa. This category is for individuals working in one of the specific qualifying fields and who have been recognised as having ‘exceptional talent’ or ‘exceptional promise’.

There is a 2 stage application process:

  1. Obtaining endorsement in a particular field.
  2. Applying for the visa.

A list of the current endorsing bodies can be found on the Home Office website. It is advisable to check this first before considering an application. https://www.gov.uk/global-talent/eligibility If your visa application is successful you will be given leave to remain in the UK for a period of between 1-5 years and can apply for an extension as many times as necessary.

It is possible to apply for settlement but the time frame for when this is possible depends upon the type of visa and endorsement.

Tier 1 Investor

This visa is for individuals who want to invest £2,000,000 or more into the UK.  Subject to meeting the eligibility criteria the initial visa is granted for up to 3 years depending on the amount invested. You can apply for an extension and or settlement. The time frame for being eligible to apply for settlement also depends upon the amount of funds invested.
