The Real Estate department at Sydney Mitchell has specialist expertise in property transactions involving pension schemes (SIPPs and SSASs), including:

  • Sales and Purchases by SIPPs and SSASs
  • Granting leases by SIPPs and SSASs
  • Secured lending
  • Joint purchase with other pension funds or individuals/companies
  • In specie contributions
  • In specie transfers

We regularly work with a number of the leading SIPP providers and professional trustees. This experience has enabled us to develop an awareness and appreciation of trustees' requirements and concerns when dealing with property which, combined with a thorough understanding of HM Revenue & Custom's pension regulations in relation to property transactions, gives us specialist expertise in a niche area of property law.

We also deal with all aspects of Landlord & Tenant law, meaning that we can arrange for leases to be put in place between the pension scheme trustees and the occupying tenant. Our specialist property litigators are also always on hand should disputes arise with tenants.

In addition, we are instructed by a number of UK clearing banks on a regular basis, and therefore when borrowing is required to fund an acquisition by a pension scheme we are often able to act for the lender as well as the pension scheme trustees.  Many lenders have certain specific requirements when lending to pension schemes, and our experience in this field helps us to ensure that the transaction proceeds as smoothly and as quickly as possible.
