Various laws and regulations are relevant to the field of advertising including the Consumer Protection from Unfair Trading Regulations 2008; the Business Protection from Misleading Marketing Regulations 2008; the UK Code of Non-broadcast Advertising, the Sales Promotion and Direct Marketing (CAP Code) and the UK Code of Broadcast Advertising (BCAP Code).

The law protects consumers from unfair practices and consumers and businesses from misleading marketing. There is specific legislation also relating to food, health products, tobacco, financial services and connected to advertising to particular groups, for example children.

Advertisers also need to be aware of the law relating to intellectual property in connection with trademarks and passing off and gambling in connection with promotional prize draws and competitions.  Provisions in the Gambling Act 2005 are relevant to distinguishing illegal lotteries and legal free prize draws or skill based competitions.

Our lawyers have experience of acting for advertising agencies including drafting and advising on terms of engagement.

We also advise on the rules relating to prize draws and skill based competitions and assist in preparing rules for competitions.
