What Types of Dismissal are there?

  • Unfair Dismissal - Unfair dismissal occurs when an employee has been dismissed and claims against their employer that the decision to dismiss was unfair. You may for example have been unfairly selected for redundancy.
  • Constructive Dismissal - Constructive dismissal occurs when an employee resigns from his/her employment as a result of a fundamental breach of their employment contract by their employer.
