Visa Granted After Expiry

When our client contacted Sydney Mitchell, he had received a shock. His spouse visa had expired the previous day, leaving him without valid immigration status in the UK. As an overstayer, he was understandably worried about the impact this could have on his future, his right to work, and his long-term plans to settle in the UK.

The Challenge

For many spouse visa holders, remaining on the five-year route to settlement is a crucial milestone. However, because the client’s visa had expired before a renewal application was submitted, there was a significant risk that any new application would place him onto the much longer ten-year route to settlement instead.

The situation was further complicated by the fact that:

  • The client believed the delay had arisen because he had not been reminded of the visa expiry date by his previous representatives.
  • No supporting evidence had been prepared.
  • A complete application needed to be assembled urgently.
  • The client also needed to pass a new English language test to meet the extension visa requirements and stay on the 5-year route.

Our Approach

Jamie acted immediately to assess the client’s position and identify the strongest available legal arguments.

Working against a tight deadline, Jamie:

  • Guided the client through the evidence-gathering process.
  • Assisted in obtaining the documentation required to prove eligibility.
  • Helped arrange a new English language test.
  • Prepared a detailed spouse visa application within the critical 14-day period following visa expiry.
  • Submitted legal representations explaining why the delay was outside the client’s control and why the Home Office should exercise discretion under the Immigration Rules.

By presenting a carefully prepared application and supporting legal arguments, Jamie was able to demonstrate that the client met the relevant requirements and deserved the opportunity to continue the five-year settlement route.

The Outcome

The result was exceptional. The Home Office approved the application just one working day after the client’s biometric appointment. Importantly, the decision allowed the client to remain on the five-year route to settlement rather than being forced onto the ten-year route. His right to work in the UK was also restored shortly afterwards, providing much-needed certainty for him and his family.
