When liability for a workplace accident is disputed, personal injury lawyers will fight hard to ensure that a fair settlement is reached. In a case on point, a substantial settlement of a man’s personal injury claim was agreed following a five-year battle.

The man fractured his femur and big toe in an accident at work. He underwent two operations and is expected to need further surgery in the future. He required extensive rehabilitation and continues to experience pain. He was off work for a long time and subsequently found a new job, as his injuries left him unable to return to his previous career.

Interim payments were agreed to help with the costs of medical treatment and the loss of his income. However, his employer disputed that it was wholly liable for the accident and made a low offer to settle the claim. This was rejected, and a settlement was eventually agreed before the man’s case came to court, whereby he will receive a six-figure sum in damages.
