There are a number of steps that you should take when you return home from your holiday. It is of paramount importance, particularly in cases involving tour operators to notify them of your claim, preferably in writing, as soon as possible. Tour operators frequently try to rebuff claims by relying on the provisions of their booking terms and conditions. Your notification does not need to be extensive or detailed but should provide enough information to the tour operator to help them identify when and where the accident or illness occurred.

You should also keep a diary of how your recovery progresses whether you have suffered an injury or illness.

It is imperative that you act quickly. Claims involving accidents or illness abroad are often subject to different time restraints than those occurring in England and Wales, for instance, in Spain claims must be "brought" within 1 year of the accident. If the necessary steps are not taken in good time to interrupt this period your claim could fail.
