The Sydney Mitchell Corporate and Commercial Services Group has developed a range of consultancy based services which are designed to promote best practice within an organisation as well as protecting against the risk of litigation. The firm has identified 3 key areas where clients are particularly venerable and could benefit from legal support and assistance, there are:
Employment
This service can include a complete review of existing contracts of employment and other employment related documentation to ensure compliance with employment legislation and case law. If there are any defective procedures, policies or documentation these will be corrected. In addition, this service can be used in relation to new ventures to ensure employment law compliance is achieved at the outset.
Commercial
This service provides a complete review of all of our client's standard terms and conditions of trading to ensure they are enforceable and that they limit the financial risk to the client. As part of the service the trading practices of the business can also be reviewed to ensure there are no issues regarding the incorporation of the client's contractual terms into any contracts with a third party.
Litigation Risk Management
This service provides a complete review of our client's existing policies when having to deal with situations which could be potentially litigious. In addition, advice and assistance is provided to ensure there is a clear policy in place which will deal with any complaints or claims which may be received. The policy is designed to avoid conflict situations from arising in the first place and will provide far better protection for the business if litigation is commenced. An initial assessment for the purpose of providing any of the above services can be provided free of charge. Any further work can then be undertaken by a range of flexible funding arrangements including hourly rates, fixed fees and capped fees. .
